Today, the Pervomaisk District Court of Murmansk held the first hearing on the lawsuit of prosecution of the Pervomaisk administrative district of the city against the public organization "Humanistic Youth Movement" to invalidate the omission, resulting in the failure to file the application for inclusion of organization in the register of NGOs that function as a foreign agent.
Before the meeting, the judge warned the media that it is preliminary, and therefore asked not to take photos or videos. For the same reason listeners were not allowed to enter the hall.
It was a surprise for the defense, as available documents indicated that consideration on the merits would take place, not the preliminary hearing. At the same time, the prosecution, apparently, was not a surprised, as the representative of the supervisory authority — the prosecutor assistant — came to court without a form and was in the judge's office long before the meeting.
The prosecution didn’t file a petition, and the defense, in turn, filed a few. At first, representative of the "HYM" Alexander Peredruk asked to attach his opinion on the prosecution’s sue to the case, stating that it was filed improperly, because, according to him, prosecution violated a number of laws during the audit, there is no evidence of the political activity of the organization, and the persecution itself violates art.10 and 11 of the ECHR.
After that the copies of previous audits of the Ministry of Justice and prosecution were attached to the case file, which resulted that no signs of "agents" among the "HYM" were found. Moreover, the Court has attached examination of the "GDM" activity conducted by a political scientist — Ph.D. candidate Elena Belokurova, opposed to examination of candidate of Philological Sciences L. V. Gorban conducted upon request of the Department for Countering Extremism.
Then the court considered a review of the Ministry of Justice, stating that the latter doesn’t support the demands of the prosecution and believes that the claim is not a subject to approval. After reading the review a judge asked the representative of the prosecution if the position of the prosecutor's office has changed, he replied that he is not authorized to modify the claim and should report the opinion of the Ministry of Justice to prosecutor, and then he asked to postpone the meeting.
Before the end of the meeting, the defense applied for calling an expert Gorban’ as a witness. The next meeting is scheduled for July 8.
